Social Security Disability in the Rocky Mountain States
Like claims related to workers’ compensation and long term disability benefits, Colorado workers and executives face an often-complicated and frustrating application process to receive the Social Security Disability benefits they need to cope with lost income and medical expenses.

At Buescher, Goldhammer, Kelman, & Dodge, P.C., our Social Security Disability (SSD) and Supplemental Security Income (SSI) attorneys have spent over thirty-five years helping individuals receive the benefits they are entitled to under the Social Security programs. We offer uncompromising representation and supportive service, providing clients with the expertise of several experienced Social Security Disability lawyers.

Social Security Disability benefits are designed to provide monthly payments and Medicare benefits to disabled individuals who have contributed to the general Social Security fund by working, helping workers to cope with the lost income and medical expenses associated with total disability. SSI is a similar program, designed specifically to help those with specific financial needs. SSD and SSI benefits are made in monthly payments to:

  • Disabled Individuals
  • Widows and widowers with spouses whose have contributed to Social Security
  • Children under 18 who have a parent that has contributed.

Applying for SSDI and SSI Benefits

Generally, to qualify for both SSDI and SSI benefits, individuals, spouses, and children who have been affected by disability must:

  • have worked and paid Social Security Taxes for a certain length of time;
  • be unemployed;
  • be disabled, or your disability is expected to last 12 months; and,
  • be unable to perform past jobs or similar work.

Unfortunately, the application process for disability benefits is complex, and most claims are initially denied for a variety of reasons, including characteristics like age and failure to meet the Social Security Administration’s (SSA) strict definition of disability. Generally, the older a worker is when they become disabled or the more information they can provide about the disability, the easier it is for them to quality for benefits.

At the time of filing a claim, the basis of the SSA’s decision to grant benefits is based largely on paperwork, and errors can be common in the early stages of SSD and SSI claims—especially where unique or complex disabilities like closed-head trauma, spinal injury, or occupational disease are involved.

An experienced social security lawyer can help individuals appeal a denial through the various administrative stages of an SSD or SSI claim. At Buescher, Goldhammer, Kelman & Dodge, P.C., we work with clients at any stage of the process, designing the best approach to helping workers receive the benefits they deserve.
